i. About Us
Bergadler is an Indian men's fashion brand selling premium apparel online through bergadler.co.in. All transactions made on this website are governed by Indian law. By using this website, you confirm that you are at least 18 years of age, or are accessing it under the supervision of a parent or legal guardian.
ii. Your Account
You are not required to create an account to place an order. If you do create one, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at support@bergadler.co.in if you suspect any unauthorised use of your account.
We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if we believe a customer has violated these terms.
iii. Products & Pricing
We make every effort to accurately display our products, including colours, fabrics, and fits. However, exact colours may vary slightly depending on your screen settings and cannot be guaranteed.
All prices on bergadler.co.in are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without notice. We reserve the right to modify or discontinue any product at any time.
In the rare event that a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the order and issue a full refund, even after an order confirmation has been sent.
iv. Orders & Payment
Placing an order on bergadler.co.in constitutes an offer to purchase. Your order is confirmed once you receive an order confirmation email from us. We reserve the right to cancel any order prior to dispatch — in such cases, a full refund will be issued.
We accept payments via UPI, debit and credit cards, net banking, and Cash on Delivery (COD) where available. All online payments are processed through secure third-party payment gateways. Bergadler does not store your card or banking details.
For COD orders, payment is collected at the time of delivery by the courier partner. Repeated refusal of COD orders may result in COD being restricted for your account.
v. Gift Cards
Bergadler gift cards are valid for use on bergadler.co.in only. Gift cards have no expiry date unless explicitly stated at the time of purchase. They cannot be exchanged for cash, refunded, or used to purchase other gift cards. Lost or stolen gift cards cannot be replaced.
Gift card balances will be applied at checkout. If your order value exceeds the gift card balance, the remaining amount must be paid via another accepted payment method.
vi. Shipping & Delivery
We ship across India. Estimated delivery timelines are provided at checkout and are indicative, not guaranteed. Delays may occur due to courier issues, public holidays, or circumstances beyond our control — we are not liable for such delays.
Risk of loss and title for products pass to you upon dispatch from our facility. If a package is lost in transit, please contact us at support@bergadler.co.in and we will investigate with the courier partner on your behalf.
vii. Returns & Refunds
Our return and refund policy is detailed separately on our Returns & Refund Policy page and forms part of these terms by reference. Please review it before placing an order.
viii. Intellectual Property
All content on bergadler.co.in — including but not limited to the Bergadler name and logo, product photographs, copy, design, and layout — is the intellectual property of Bergadler and may not be copied, reproduced, distributed, or used without our prior written consent.
You may not use our branding, imagery, or content for commercial purposes, on social media, or in any other context without explicit written permission.
ix. Limitation of Liability
Bergadler shall not be liable for any indirect, incidental, or consequential damages arising out of your use of this website or your purchase of our products, including but not limited to loss of data, loss of profit, or damage to property.
Our total liability to you in connection with any order shall not exceed the amount paid by you for that specific order.
x. Privacy
Your personal information is collected and used solely for the purpose of processing your order and communicating with you. We do not sell, rent, or share your data with third parties for marketing purposes. By placing an order, you consent to us using your contact details to send order updates and, where opted in, occasional brand communications. You may unsubscribe at any time.
xi. Governing Law
These terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these terms or your use of bergadler.co.in shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
